4.1 HOMOSEXUALITY AND LIVE IN RELATIONSHIP In India, homosexuality is termed as an â€Å"unnatural† practice and hence liable to punishments and penalties. It’s not legal for gay people to marry in India. Section 377 of the Indian penal code (IPC) penalizes homosexuality. The penalty for engaging in homosexual activities can extend to life imprisonment in India. Homosexuals hence, can’t marry in India, hence most of them choose to have a live in relationship. Homosexual relationship is not regarded as a relationship in the nature of marriage, hence all the benefits accorded to a couple in a live in relationship are not extended to homosexuals. In the Naz foundation case , the definition of the â€Å"word† sex in article 15 of the constitution was interpreted to include sexual orientation. Hence, discrimination against someone on the basis of their sexuality should be regarded as violation of article 15 of the constitution. In many countries like UK, US, some parts of Europe, homosexual marriages have been legalized. However in India, it’s going to take a lot more time. Same-sex unions are recognized in some form or the other in countries now, including – Argentina, Brazil and South Africa.
